She is surprised when she sees a very large sign in the window of Le Petit Chateau that reads, 'Today only. 75% off everything. We're relocating and we need everything gone!'
Loralee instantly turns into the drive of Le Petit Chateau and rushes into the store. She keenly looks around, but sadly most items have 'sold' or 'waiting for pickup' tags on them. She does notice a very beautiful antique vase on display in a corner of the store, protected behind a glass cabinet. She can see a small price tag dangling off the vase that reads $1,000.
Loralee is a trained antiquarian and the vase looks suspiciously like a Louis XV era vase. As she inspects it closer, she wonders if it might actually be from that period. If so, the price of $250, taking the 75% off sale into account, is an absolute steal. She quickly pulls out her phone and takes a picture so she can research the characteristics a bit more.
Vendeer, the salesman at Le Petit Chateau approaches Loralee while she is on her phone and asks if he can help her.
Loralee doesn't want to create suspicion that she is researching the vase and decides that for $250, the vase is worth the risk.
"Yes. I will take the vase for $250," she says.
Vendeer looks apologetic. "I'm so sorry, but the vase is not part of the 75% off promotion. That's why it is in the glass cabinet."
Loralee is quite surprised as the vase is in the cabinet and the cabinet is in the shop. She tells this to Vendeer. Vendeer apologises again, but tells Loralee that the vase is a really valuable imitation and that he can give it to her with 25% discount.
Loralee is unsure. She wants to consult with one of her colleagues about the vase to try and determine whether it is authentic. However if it is authentic, she knows that the vase is worth a lot more than the asking price. It is clear that she is uncertain, so Vendeer says, "I can hold open the 25% discount until tomorrow at 1pm, if you need to think about it."
Loralee nods. "Yes, please."
Loralee goes to her office and consults a colleague who confirms her suspicions, that the vase is authentic. Excitedly, Loralee rushes back to Le Petit Chateau after her morning classes the next day. She arrives at about 12.30pm and to her utter horror, she sees a man walking out of the store with her vase. She quickly finds Vendeer. Before she can say anything Vendeer let's her know that the vase has already been sold and so he cannot offer it to her any longer.
Loralee is shocked and extremely angry. She comes to you for advice on the following:
a) is Le Petit Chateau allowed to exclude the vase from the sale ?
b) is Le Petit Chateau allowed to sell the vase to another customer?
