Text Book : Property Law by Penelope McCann First Edition

Q: Phil and Claire are clients who are interested in investing in real property. They have the following questions:

  1. Does holding a fee simple estate mean that they own the land absolutely?

My Answer: Fee simple ownership is the highest form of ownership. It allows the ownership of the land and any structures on it. The land is owned by original grantor and can be transferred to his generations.

Tutor review feedback: Good, but technically someone owns all the land in Australia, Who and why? who own the land absolutely? Please refer to ch2.3 Limits of Real Property rights under Helpful Tip: Also Refer to Ch2.5 Interests in Land- Doctrine of Tenure.

What would be the best answer for this?

Thanks
