THE BUSINESSPERSON enters into an agreement with THE DISTRIBUTOR in terms of which THE BUSINESSPERSON pays thirteen (13) monthly instalments of [R500 000] to THE DISTRIBUTOR for the import and export of products that The Company of the BUSINESSPERSON deals with and manufactures. Whilst preparing to pay the fourteenth monthly instalment, THE BUSINESSPERSON becomes aware of the fact that the agreement is [and has been] in contravention of The Customs and Excise Act 91 of 1964. Upon the discovery, THE BUSINESSPERSON seeks to claim back the money already paid in terms of the agreement. Fully advise THE BUSINESSPERSON on: i. The legal position regarding the agreement. [5] ii.
