The new york yankees are moving to Boston next month and there are many shops outside where the Yankees are supposed to play. Smith wanted to rent a shop that is right across where they play to sell Merchandise. Jones offered Smith a price of $5000 per month which Smith agreed to pay. Before Smith signed the lease, Smith told the landlord that he cant rent out shops to people that want to sell the same products Smith intends to sell. Jones agreed. The day they signed the contract this wasnt in the contract, however they both signed it. The day before the Yankees were supposed to move to boston they decided not to move to boston anymore. Smith wants to seek legal advice in order to sue Jones for some money. Is it Joness fault for not including it into the contract? even though Jones verbally agreed. During the time Smith was running the shop Smith decided to make improvements and hired a company to make $50,000 worth of improvements. Smith didnt have enough money to pay the company. Smith asked his friend Walker to help her with the money. Walker writes a letter to the company which states I am Kyle Walker and I promise to pay you $50,000. The company seeks legal advice on how they should proceed to receive the $50,000 from Walker.

  1. Smiths rights to money from Jones?

  2. Is it Joness fault for not including it in the contract?
