The plaintiff, Mr. Poolish a man of 65 years of age, was introduced by his spiritual adviser, Mr. Wisecracks, to the defendant, Mr. Pennywise, who was the Spiritual Head of an esoteric meditation centre called "You Check out Anytime". Four years later, the plaintiff joined the centre as a full time mendicant and was required to surrender all his property as he took the vow of supposed poverty. He remained in such a position for some nine years, during which he transferred property worth about RM X,XXX to the defendant, who had used most of the proceeds of the property for the purposes of the centre. About two years after he left the centre, Mr Poolish claimed the return of the remaining money on the ground that the property had been procured from her due to a vitiating factor affecting the validity of the transaction.
