"There are three types of recording statutes - race, notice and race-notice. In states that have a pure race statute, the first person to record their instrument wins regardless if they knew or did not know that the mineral rights were already conveyed to someone else before them. Some people think that this type of statute isn't fair because people that are poor or have limited means of transportation, will have more difficulty getting their instrument to the clerk's office to record the instrument. Other people think that the race statute is very fair because it is an unbiased means of notice. Which of the three types of recording statutes do you think is the most fair and why?"
