This assignment is not about statutory history, that is, how one enacted statute was changed by later enacted statutes. For this assignment, refer only to the legislative history.
- Locate a California statute that has been enacted into law that has legislative history including at least one change in the text of the bill from its introduction to its enactment. The statute may be on any subject but the change in the text must be in the form of a modification of relevant text (and not gut-and-amend*). Acceptable statutes include statutes that have been enacted as law ("chaptered") but are not yet effective as law (because, for example, the statute will become effective next January 1).
*Gut-and-amend is where a bill is introduced with text either that is expressly a placeholder for future text or contains text relating to a different subject. The old text is completely removed by an amendment and replaced with entirely new text, sometimes on a completely different subject. This legislative process is used to avoid limitations on the introduction of new bills by effectively creating a new bill out of an existing bill.
Provide a description of the law as it has been enacted, including a complete citations to the statute and to each section of each Code which the statute amends or enacts. Explain the purpose of the statute and how the new statute changes existing law.
Explain the legislative history of the statute, including what reports were made in the legislative process and how the text of the bill changed from its introduction to its enactment and what was the effect or purpose of the changes. If the effect or purpose is not clear from the legislative history, provide your own analysis of why the text was changed.
