Tillie parked in the Main Street Garage, a private parking garage for her condominium complex. While Tillie is parking her car in her assigned spaced, a support beam becomes dislodges and falls on Tillie causing Tillie to sustain serious physical injury. It turns out that the steam pipe had been improperly installed, causing it to come loose and fall over time. Proper maintenance by the Main Street Garage would have provided notice of the improper installation and allowed the garage to correct the defective installation. When Tillie reported the damage told the parking garage manager, she was told that Market Street Garage would not pay for the serious physical injuries she sustained. The garage manager referred Tillie to her lease, which contained a provision which read that "Market Street Garage is not liable for any damage to the lessee or the lessee's vehicle, even if the damage results from the garage's own negligence." Tillie seeks your legal advice as to her chances of recovering damages from Market Street Garage. What is your advice?
