Unlike much of the popular media (e.g. newspaper and magazine reports, newscasts, etc.). a class on healthcare regulation and ethics uses the case method not only to study and discuss the unanimous or majority decision in a case, but also to analyze the minority opinions (if any). Why then do we need to learn and understand the dissenting opinion of judges and justices in a case and include them in a case brief? CHOICE 2: Dissents are seldom reported in the popular media, leaving the reader or viewer with a limited or narrow perspective of the court's ratio decidendi and holding in a particular case. CHOICE 2,3, and 4 only CHOICE 3: Dissents offer a different approach or perspective to some or all of the key issues raised in the case by the disputing parties CHOICE 4. The case method requires a balanced approach and consideration of majority and minority holdings in a particular case. CHOICE 1: Dissents are likely to be used as arguments to overturn the majority decision should a similar case arise in the future, which a court is willing to hear and consider.
