Michelle Smart and Herman Kline are 30 years old. Michelle is a software technician and Herman is a chef. Michelle and Herman plan to get married in Mexico in two months and Michelle has met with the lawyer at your office. Your lawyer has asked you to draft a preliminary marriage agreement based on the facts that he scribbled on a notepad during his meeting with Michelle. Once you have drafted the marriage agreement, your lawyer will then review the agreement for accuracy.

Facts:

  • Michelle and Herman have never lived together
  • Currently they do not own any assets together
  • Michelle owns a condo in downtown Vancouver valued at $550,000.00, which has a mortgage of $300,000.00
  • Herman does not own any property in Canada but is on title with his parents on property located in Indonesia
  • Herman collects art and has recently acquired an expensive piece from France valued at $10,000.00
  • Upon marriage, Herman will move into Michelle's condo and each of them will contribute equally to the expenses
  • Neither Michelle nor Herman has children

  1. Formatting: Your marriage agreement must be submitted as a WORD document:
  2. Use Times New Roman 12 font
  3. Keep the spacing same as the precedent
  4. 1" margins
  5. Money within the agreement clauses should be expressed in words then figures. Ex: The sum of NINE HUNDRED AND FIFTY (950.00) DOLLARS. (Refer to Clause 1 page 169Legal Keys)
  6. The signature block should never be typed on a page by itself. Make sure that you include at least 2 lines of text with the signature block and use the Z-line as needed.
  7. You can add to the facts as need. However, do not change the facts given here.
  8. Make sure to proofread and edit the document before submitting so that you only have the client's information.
