"A contract for the sale of goods for the price of five hundred dollars or more is not enforceable by way of action or defense unless there is some writing sufficient to indicate that a contract for sale had been made between the parties and signed by the party against whom enforcement is sought or by the party's authorized agent or broker. A writing is not sufficient because it omits or incorrectly states a term agreed upon, but the contract is not enforceable under this paragraph beyond the quantity of goods shown in writing."

Assume that the act applies to the sale of goods.Goodsare defined in 2-100 as "those things movable" and do not include real property. Mary orally contracts to buy 10 car tires at $70 each.The seller prepares a contract and gives it to Mary. Neither party signs the contract.

QUESTION: Assume both parties sign the (newer) contract and it reads 15 tires at $70 each.

Is the contract enforceable under the Statute of Frauds?If so, to what extent is it enforceable?

It would be my first choice that it is enforceable as a renegotiated contract to the full extent of 15 tires at $70 each, a total of $1050. It is signed by both parties which is considered an acceptance by Mary to purchase 15 tires instead of 10, and the newer contract is in writing as required for contracts over $500. Am I correct?
