There are two possibilities: EITHER actual malice OR negligence. Make sure that the case upon which you rely (1) addresses Kentucky law and is not describing what other states do; (2) addresses what PRIVATE PERSONS must establish and not what public persons must establish; and (3) has not been overruled. It is generally preferable to rely on case law from the highest court in the state, but if that case is old (20 years or more), it may be a good idea to search for more recent cases from the intermediate appellate court in the state.
