Shortly before going on her maternity leave and parental leave in January 2020, Ms. Alice had been promoted from an instructor position to that of Program Coordinator. After Ms. Alice went on leave, Ms. Dorothy was hired to replace her, and was subsequently promoted to the position of Managing Director. In this position Ms. Dorothy took on the role and responsibilities of the Program Coordinator.
On December 12,2020, shortly before Ms. Alice was due to return from her leave, Ms. Dorothy informed Ms. Alice that her position had been "closed" and that her employment would be terminated at the conclusion of her maternity leave in January 2021. Ms. Dorothy told Ms. Alice that the elimination of her position and termination of her employment were the result of declining student enrolment and resulting financial problems being experienced by Vaneast.
Ms. Alice feels that she has been discriminated against and approached Vanweast about their treatment of her. Vaneast submits that it terminated Ms. Alice's employment solely for legitimate business-related reasons having nothing to do with her pregnancy or leave.
