This video relates to family law because it discusses alimony and the factors that determine the payment amount given to the spouse. Lastly, Spousal Support and Alimony are usedinterchangeably in family law.

Unlike child support in New Jersey, there are no specific guidelines that determine Alimony. Every Alimony case is unique and different, so the amount awarded will be determined by the courts. There are several factors that the courts look at when determining Alimony in NJ.

1. The length of the marriage
2. each party earning capacities
3. How many children the parties have
4. The health of the parties

There are TWO main types of Alimony

1.Open Durational Alimony

There used to be a term used by the courts called permanent Alimony. However, the statue for Alimony changed in NJ. Now the courts use the word Open durational Alimony. Which means that marriages that are 15- 20 years or more will be open to the open durational Alimony because there is no set end date to the Alimony

2.Limited Durational Alimony

This term means that there is an economic need for Alimony. The length of marriage was too short to warrant open durational Alimony. Alimony is usually tied to an event. For example, when will the supporting spouse finish school? Or when the party's youngest child goes to first grade and the supportive spouse can gain more earning capabilities.
