You enter into a contract with Shifty McShiftyson to sell him a 10 speed motorized skateboard for $750.00. Thirty days after the contract is signed, however, you have the skateboard ready to go but Shifty hasn't paid you the purchase price. You notify Shifty that unless he pays the purchase price, which was due 15 days ago under the contract, you are going to treat his failure to pay as a material breach. You don't hear back from Shifty, so you end up selling the skateboard to Speedy Coolguy, who pays you $550.00.
