You represent Aggie Oil, the operator of certain leases in Tarrant County. One of the non-operators has proposed using the new 2015 version of the AAPL Form 610 JOA. Aggie Oil management has asked you to write an opinion on what impact the amended wording of Article V.A. has on the Operator's exculpatory clause, precisely, does it expand the Operator's liability and/or change the result from the Reeder case and whether Aggie Oil should accept the new wording or what amendments Aggie Oil may want to propose to the new JOA wording.
