YOUR TASK: Advise Kezia on the following four issues. You should address each issue using an ILAC structure. In other words, for each issue, set out the issue (stated below), then the law relevant to that issue, then your analysis, then your conclusion on that issue. Issue 1 - In relation to the information about John working for the Russian Government and that he was doing investigation and observation of Aotearoa University staff - would John have a successful claim in breach of confidence against Kezia if she was to write, and publish in the student newspaper, an article that included this information? 20 marks N Issue 2 - In relation to the information about the law student that may have been cheating - would that law student have a successful claim in breach of the tort of privacy against Kezia if Kezia was to show her four flatmates (who are also law students) copies of the correspondence about the cheating allegation, that she has photographed? 20 marks Issue 3 - In relation to the information about the University trying to cut costs and possibly closing the cafe and the library building- would the University have a successful claim in breach of confidence against Kezia if she was to write and publish an article in the student newspaper that included this information? In relation to the public interest issues that arise, you must analyse who would have the onus of establishing that it was in the public interest to restrain or allow disclosure. (Note - Aotearoa University is a tertiary institution to which the Education Act 1989 applies.
