Interpretation o f St atute Muscarello illegally sold marijuana, which he transported in a small truck. Police discovered a handgun in the locked glove compartment of the truck. A provision in the fi rearms chapter of the federal law demands a fi ve-year required prison term for persons who use or carry a fi rearm during or related to traffi cking in drugs. Muscarello claimed that since the gun was in the locked glove compartment of the truck it did not fall within the description of the word “carry” as used in the statute and that he was not subject to the required fi ve-year prison term.
