In an effort to curb their escalating health care costs, some businesses have implemented policies that ban smoking off duty. Employees of these businesses must agree to submit to random nicotine testing and are terminated if they test positively. This practice is legal in some states but prohibited in others. Are there other currently legal off-work activities such as overeating or engaging in risky behavior such as skydiving or rock climbing, that you feel employers may seek to restrict in the future?
