Johnson Controls, Inc., manufactures batteries made primarily of lead. Lead is a dangerous substance for pregnant women because exposure to lead can harm the fetus. For this reason, Johnson Controls excluded women who are pregnant or who are capable of bearing children from jobs that involve exposure to lead. Numerous plaintiffs, including a woman who had chosen to be sterilized to avoid losing her job, entered a federal district court class action suit alleging that Johnson Controls’ policy constituted illegal sex discrimination under Title VII of the Civil Rights Act.
