They reinstated the death penalty in Gregg v. Georgia, stating procedures had changed to eliminate these racial components that led to a higher proportion of minorities being sentenced to death row. Statistics show this to be incorrect. Are there any procedures that could actually remedy this, either during the investigation or at the trial or appeals level? Stated otherwise, could we provide a safeguard to protect minority populations from disproportionately being sentenced to death?
