Robert Smith is a potential new client.He isan expert skier who has skied at
dozens of different destinations in the U.S. and abroad. The events in
question occurred recently at the Doom Mountain Ski Resort, where Robert
and a group of friends had met for a weekend trip.
On their first day on the slopes, the group bought lift tickets which had this
statement printed on the back: "By purchasing and carrying this lift ticket, I
acknowledge that skiing is a dangerous sport with certain inherent and
unavoidable risks, and I agree to accept these risks and to not sue Doom
Mountain Ski Resortin the event thatI suffer harm from these risks while
using the Doom Mountain Ski Resort facilities."
The morning of the group's first day was great. At lunch, although some of
Robert's friends decided to have a few alcoholic drinks, Robert had wanted
to keep his wits about him and so had limited himself to a single beer.
After lunch, the group decided to try "Fool's Delight", one of the mountain's
most difficult runs. On the left side of the run was a line of trees and lots of
large signs that read: "SKI AREA BOUNDARY - NO SKIING PAST THIS POINT."
The right side of the run was smoothly groomed all the way to the edge. Just
beyond the edge, the ground dropped off severely down an ungroomed,
rocky cliff. No signs or other obstructions warned of this danger, despite the
despite the
fact that this violated a state law that required ski resorts to post notices
warning skiers of ski area boundaries and especially dangerous areas.
Unfortunately, because of the way the snow was blowing in the wind at the
time he entered the run, Robert did not see the steep drop-off to the right.
Instead, he skied right over the edge of the run and plummeted down the
cliff, suffering a concussion and a broken leg.
