QUESTION 1

On 01/06, Kim Mi-Mi wrote to Park So-Yi offering to sell her restaurant at the price of

RM500,000. Kim Mi-Mi gave Park So-Yi until 10/06 to reply to her offer. Park So-Yi received the offer letter on 03/06. On 09/06, Park So-Yi decided to buy the restaurant and sent an acceptance letter on that day. Meanwhile, Kim Mi-Mi suddenly felt guilty to sell the restaurant and decided to cancel her offer by sending a letter to Park So-Yi on 07/06 informing of her intention not to sell the restaurant. Park So-Yi received the letter on 10/06 and Kim Mi-Mi received Park So-Yi's acceptance letter on 12/06.

Park So-Yi really thinks the restaurant is already his. Advise Park So-Yi.

Emping is married to Empong. When Emping's salary as an office boy has become

insufficient for the family, Emping quit his job and left for Singapore to search for a better job. Empong and their 7 kids were left with little cash to fend themselves. Their neighbour, Pak Demang felt sorry for them and gave Empong RM200 monthly for 6 months until Emping at last came home to his family. When Empong told Emping of Pak Demang's kindness, Emping went straight to Pak Demang and promised to pay Pak Demang RM2000 for his help. A year went by but Pak Demang never received the money.

Advise whether Pak Demang could file a claim against Emping.

PART B (ANSWER THIS QUESTION)

Salah and Betul got married recently. Salah suggested that they would go to a local resort popular for its adventurous forest activities in Melaka, KitaJagaKita Resort (KJKR). Salah bought the honeymoon package from KJKR for two nights and three days and they went off to the resort on one weekend.

The package included a rafting down the Melaka River activity arranged by the staff of KJKR. Betul was so excited to join the activity as she was once her school representative for the National Kayak Championship. Before the activity took off, both Salah and Betul were reminded of all the safety precautions by the staff in charge. They were also told that an employee of KJKR was stationed down the river to caution them to stop rafting at that final check point.

Unfortunately, the raft they were on passed by the final check point because there was no one there to instruct them to stop and the raft broke after hitting several big stones after the checkpoint. Betul had a seizure for being too long in the cold water and was hospitalised for one week. Salah and Betul wish to take an action against KJKR.

Advise them.
