how to respond to this

My company engages in the "Fair Labor Standard Act". 13 weeks out of the processing season, employees are exempt from overtime pay. They will only get paid regular time for any hours over 40. I heard they're allowed to use this law because they process tobacco. Any company that manufactures tobacco or any other farming product, can use this law. I don't see where this law is fair, especially not for the employees.
