On 9-11, 2001, Terrorists stole 4 airplanes and flew them into the World Trade Center, the Pentagon and a Field in Pennsylvania (the so called hero flight that overwhelmed the terrorist and crashed the plane to avoid striking other American citizens). A tort law suit was brought by victims' families in the New York courts against New York officials for not preventing this action. Should authorities be held liable when such a terrible act occurs? This question has arisen in cases in Indiana. In one case, a female deputy had a criminal handcuffed to a bed in the hospital and he overwhelmed her and took her gun. Then he shot her and several nurses and doctors in the hospital. Should the Sheriff be liable for failing to provide better security? What "tort" occurs here? What standard should apply to police and other officials to keep us safe from such actions?
