The penalties for each offense are different. Maryland 1st DUI penalties include facing up to a year in jail, up to $1000 in fines, and a six month license suspension. If there was a child in the car the maximum jail time and fines double. The penalties for a DWI is up to two months in jail, up to $500 in fines and a license suspension for up to six months.
