This week, we make our turn into case law, starting with a important Supreme Court opinion from the 1980s. In Ward v. Rock Against Racism, the Court considered a regulation that required musical acts performing at the Naumburg Bandshell in Central Park to use city-provided amplification systems and technicians, not allowing them to use their own equipment or personnel. While it seems technical and almost unimportant, this is a very significant case. As you read, remember to keep your eyes on the prize. What are the free speech considerations, and how do the Justices talk about them?
To complete this, you should read Justice Kennedy's majority opinion, (the opinion begins on page 781, but start your microsummary on page 790) which covers 790-803. As you read both, look for two key things-1) the holding/what the Court ruled and why, and 2) how they justified that holding. In other words, all those tools from the first several weeks about narratives, rhetorical situation, etcsee if any of them help you pick up on how the opinions become persuasive. In your microsummary, you'll want to represent the core ideas of the opinion. Do take a minute or two to skim the opening of Marshall's dissent, but you need not go through it in depth or represent it in the microsummary.
After you have worked through the opinion/as you proceed through it, your task is to represent the core ideas of the majority. Do so by summarizing the reading in the following format:
