Max was born in a San Diego detention facility as her parents were awaiting "processing" into the United States. Unfortunately the family was denied "official" approved access to the United States. Eighteen years later, Max was awarded a scholarship to attend the University of Southern California in Los Angeles. Max and her family were thrilled! However, a huge complication arose. It seems there was recent state legislation that prevented non-citizens and "non-resident aliens," from receiving public scholarships to attend universities within the State of California. This decision was not subject to any independent judicial determination for anyone considered a non-citizen. Max was deemed a non-citizen because her parents were undocumented. However, Max felt that she fit within the concept of "birthright" citizenship under the 14th Amendment to the U.S. Constitution. Max and her family believed she was being discriminated against. Therefore, Max sued the University of Southern California ("U.S.C.") and the State of California alleging violations of her due process and equal protection rights under the U.S. Constitution. Max cited the 5th and 14th Amendments to the U.S. Constitution to support her position that she was entitled to receive the scholarship "just like everyone else." a.
