Workers' Comp fraud is fastest-growing area of fraud. The NICB reports Workers' Comp fraud accounts approximately 25% of fraud perpetrated and costs $7.2 billion annually. Claimants take second jobs while collecting disability benefits for injuries they claim left them unable to work. Surveillance was proper method to use, because it proves/disproves legitimacy of injury and used to investigate employee workers' comp fraud. Surveillance is performed by private investigator who take time/date-stamped photos of worker. If worker is injured on job and claims he is unable to do work due to injury, surveillance can show if he is injured from photo evidence procured during surveillance operation. There's restrictions on how far employer or insurance company can go when conducting surveillance. The investigator should make sure he's not violating person's reasonable expectation of privacy under Fourth Amendment to Constitution, which protects right of person against unreasonable searches. Surveillance should be conducted if other techniques fail. Consultation about privacy is needed beforehand so that observation conducted is legal and valid.
