You have just graduated with your degree and you've secured a job in a big city working for an up-and-coming company, led by a young entrepreneurial CEO. You have been selected to serve on the marketing committee. One member of the committee, Hank the Hustler, never took Business Law BUA350, and learned his marketing skills through trial and error, and "on the job" working for a number of different companies. Hank loves his sales position with the company, as his yearly bonus is tied directly to his regional sales, and historically his sales have remained steady and increased. Through your experience with Hank, you learned early on that Hank does what is best for Hank, and his interest in the success of the company is limited by his own interest in increasing his salary and yearly bonus.

Over time, the company's sales steady and level off as new competition enters the market. The CEO has tasked you and the marketing committee to address the important issue, securing market share of your product against the increasing competition in your industry. Hank feels that the company needs to adopt an aggressive marketing strategy, because in his region his sales are dropping, and he has concerns over the health of the company's future (not to mention his need for monthly payments on his mini-mansion, and sports car). Hank suggests that the best method to secure, and gain market share is to operate with a tactical approach targeting your competitors' respective market shares and cater to their customers, to in effect drivecompetitors out of the market. Hank suggests the best way would be to survey prospective customer's to learn which customers use a competitor and to systematical try to obtain their business. As an integral member of the marketing team, use your knowledge of the tort of tortious interference with contracts, to discuss the best method to proceed in identifying prospective customers, and what actions your company should avoid? Thanks
