You work for Allen Steel for 10 years, and are an exemplary employee. But you just got a new manager a few months ago, and she is a real piece of work. She micro-manages everything you do, even though you know more about your job than she does. If you're 1 minute late, you are chastised in front of the whole work crew. If you aren't smiling when you work, she yells at you to "put on your happy face". She constantly belittles the quality of your work, with comments like "an ape could have put that one together better than you did"., despite the fact that your work was satisfactory. She's taken away your lunch hour and made it a lunch half-hour, and demoted you from foreman to lineman, with no explanation and a big cut in pay. Your nerves are shot, you're exhausted, and when you try to talk to her about it, she says you'd just better get used to it, because there's a new sheriff in town. Your reputation in the company is ruined, and no other department will even consider you for a transfer because she's basically blackballed you.

You can't take the stress any more, and walk out one day when she tells you it's a miracle she hasn't fired you yet. When you apply for unemployment benefits, your company disputes your claim, and says you quit on your own so you don't qualify.

What might you claim (other than some kind of discrimination claim) related to your discharge? Explain in detail. Look at the scenario from the previous assignment, and think about the behavior of your boss to you, in front of the entire work crew.

What tort claim might you have against your employer? What would you need to prove as elements of your claim? Remember: Explain means to use terms and concepts from your text to demonstrate you understand the question and the answer you're giving.

Include a discussion of how worker's compensation laws might affect the amount of money damages you might claim.
