1. The government of British Columbia (BC) has decided that all people living in British Columbia should be vegetarian. In addition to health benefits, the BC government argues that the transport of meat into or through the province can increase the risk of certain diseases, including Foot and Mouth Disease. To help with the goal of having British Columbians become vegetarian, the BC government has passed new legislation called the "No Meat Transport Act".Essentially, the legislation bans meat from being transported from outside BC (including other Canadian provinces) into or across BC.

Red Deer Meats is a beef meat produce and processor in Red Deer, Alberta- the province next to BC.Red Deer Meats needs to ship its meat to the ports in British Columbia so that the meat can be shipped by boat to various countries in Asia. When a Red Deer Meats truck arrived at the provincial border between BC and Alberta, BC government inspectors stopped the truck and forced it to turn around and not enter BC.

Gordon Ho, the president of Red Dear Meats, believes that the BC government has no right to stop the transport of meat through BC, especially since it is being shipped overseas. The BC government claims they have the right to protect the local population and environment, including maintaining health and protecting from disease.

On Behalf of Red Deer Meats, Gordon Ho has hired a lawyer to sue the BC government, as the BC government may have violated (broken) the Canadian Constitution in creating the No Meat Transport Act.

Note:The No Meat Transport Act is not a real law- it has been made up for this case study.
